TERMS AND CONDITIONS
We, Jaagruti Tourz, look forward to the opportunity to act as your booking agent for your travel needs. These terms and conditions describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to Jaagruti Tourz – the term “you” refers to the customer booking a reservation through us or otherwise using our services. It is imperative that you and all the passengers who are joining our tours whom you represent shall abide by and strictly comply and observe all the terms and conditions laid own herein. By booking yourarrangement with us, you are agreeing to be bound by the terms of this Agreement.
Scope of Activities
We are basically travel and holiday organizers only. We act as an intermediary or a ‘Booking Agent’ for products and services that are supplied to us (e.g. air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor nor do we own or control or operate any airline or any other mode of transport like shipping, railway, motor, buses, coaches, etc. or any hotel or restaurant, other facility or services. We take utmost care in selecting all the ingredients for making your holiday a comfortable one. We only select but do not have any control in running them. We are acting as an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our Suppliers as a result of this Agreement. Thus, we are not responsible for any death, breakdown, injury, loss, personal harm, delay, discomfort, irregularity, increased expenses, consequential loss or damage to baggage and / or any person or property which may be caused by the act of the management or employees of any independent contractor and arising outside our normal selection and inspection process. We shall also not be responsible for any change in the weather conditions, strikes, war, quarantine and any other cause whatsoeverand all such losses or expenses must be borne by the individual passengers themselves.
Jurisdiction
All disputes pertaining to travel related services conducted by us and any claim arising there-under shall be subjected to Mumbai Jurisdiction only.
Delays and / or Cancellations from Airline’s company
In case of any predicament taking place in an Airline’s company and as a result of which, if your booked flight/s, get cancelled, rescheduled or delayed which is beyond our control then we are not responsible for any compensation, refunds or any alternate arrangements, claims, losses and / or consequences arising due to the same.
Deposits and Payments:
The registration fee of Rs. 25000/- must be paid at the time of booking is a non-refundable and interest free amount. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. Above is just a quotation doesn’t guarantee any room space nor should be treated as a confirmation. The price can only be guaranteed once we receive full payment and other travel documents have been issued. If full payment is not paid in time, we reserve the right to cancel the booking with subsequent loss of deposit and apply the cancellation charges as mentioned below. In the case of billing errors, we reserve the right to re-invoice with correct pricing. In case of dishonoured cheque, passengers will have to pay `1000/- for every such dishonour. A cheque dishonoured is an offence under the Negotiable Instruments Act and the Company reserves its right to take necessary legal action as may be advised.
Visa
The tour cost offered by Jaagruti Tourz is based on the prevailing Visa charges levied by the respective consulates. If any increment in the visa fees comes to force which is beyond our control, then we are not responsible and the same will have to be borne by the passengers themselves.
All passengers traveling internationally with Jaagruti Tourz must be in possession of a valid visa. It is at the sole discretion of the Consulate/Authorities to ask for original documents/personal interview of the passengers at any time. However, as granting or rejecting visa is the sole prerogative of the concerned Consulate/Authorities even after submitting all relevant documents, we will not be held responsible for the same. In case the Visa application is rejected by the concerned embassy/consulate or authorities, due to incomplete/delayed documents furnished by you or due to any other reason whatsoever, or there are errors in the date of visa granted or scanned photographs on the visa, we shall not be liable or responsible for the same. All costs and charges in respect of the said application for the visa shall be borne by the passenger. If the passenger needs to cancel a tour due to rejection of visa or rejection of entry into the country, our cancellation charges will be applicable and shall be payable by you. There will be no refund if you, or any member of your party, is unable to travel due to the said reasons. Any fines, penalties or any such payments arising due to not meeting with the requirements of any airport or government authority in respect of Passport or Visa documents, then it will be sole responsibility of yours.
Hotels/Rooms
For all tours, accommodations in the hotels are made in the base category rooms only (Unless otherwise specified). Triple rooms are not larger than twin rooms and the third bed is often a roll-away mattress put in a twin / double bedded room. Single person will have to pay single occupancy charges. If single person seeks for a partner and the partner is available, twin sharing charges will be applicable. In case any of the partners gets cancelled the other person will have to pay single occupancy charges. Single person not willing to pay single occupancy charges will have to share a room with two or three co-passengers, subject to availability or else has to wait till the willing person books the tour. International Check in time of the hotel is 1400 hrs. & check out time is 1200 hrs. No guarantee for early check in or late check-out. Should you require rooms prior to the standard check-in time, the room must be reserved from the previous night. Any damages caused to the hotel rooms / coach during the stay shall be borne by the passenger itself. Jaagruti Tourz will not be liable for the same. No claim for loss of Baggage will be entertained by us.
Cancellations and Refunds
If you cancel your arrangements, you may / may not be entitled to a partial refund as per the chart given below:
✔ 30 days or more prior to departure —- Rs. 25000/-
✔ Between 29 -15 days prior to departure —– 25% of the tour cost, whichever is higher.
✔ Between 14 – 10 days prior to departure —- 50% of the tour cost.
✔ Between 09 – 05 days prior to departure —- 75% of the tour cost.
✔ Less than 5 days prior to departure —– 100% of the tour cost.
✔ Visa Fees will be the charged over and above the cancellation policy.
✔ Cancellation charges for the Airlines Ticket will be over and above the cancellation policy mentioned above and will be as per the Airline’s cancellation policy.
✔ No refund will be given on any unutilized services, pre–booked shows, rides, sightseeing, any visit to special places.
✔ The refund amount will be given by way of post-dated cheque (60 days) from the departure date after deducting the cancellation charges.
✔ All the services are prepaid and no refund will be given for any unused portion of the tour or if any sightseeing is missed due to delay in flight, vehicle breakdown or any natural calamity. Or political disturbances or any whatsoever reason beyond our expectations and control.
If You Have a Complaint
If you have a problem / complaint pertaining to hotels; cruise, transfers, restaurants, sightseeing, etc., please inform the relevant supplier immediately. If they ‘re unable to resolve the matter, please contact us. If you fail to contact us on time, or if you complain after arrival, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.
Travel Documents
It is your responsibility to ensure that all of the details on your travel documents (e.g. your passport, tickets, visa) are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc. It is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with us. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
Insurance
Travel insurance is a vital part of your arrangements. We strongly recommend that you take out adequate insurance for the duration of
your journey.
Covid-19 Restrictions
The requirements for RT-PCR test to/from India and UAE / any country are subject to any last-minute amendments by the concerned authority and must be followed by the travellers at their own expenses.
